TERMS AND CONDITIONS

AGREEMENT: All agreements are contingent upon approval by Management. By signing up for or using the services of EnviroGuard Solutions (“we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Agreement”). Please read this Agreement carefully before using our services.  The customer must ensure that the premises, structure, building, and/or dwelling are accessible for services as required and scheduled within the scope of the agreement. If the property is not available at the scheduled time, all trapping activities will be suspended until access is provided to the wildlife/pest control technician and EnviroGuard Solutions. This agreement constitutes the entire understanding between the parties, the client and EnviroGuard Solutions and replaces any prior agreements, whether written or oral, concerning the services. Estimates are valid for 45 days due to fluctuating material costs. After 45 days EnviroGuard Solutions may require a return visit to re-evaluate the solution(s). 

CONSENT TO COMMUNICATION: By signing this Agreement, you consent to receive communications from EnviroGuard Solutions electronically, including via email, text messages, and phone calls, regarding the services provided. These communications may include important updates, reminders, promotional offers, and other service-related information. You agree to provide accurate and complete information for the purpose of communication and service delivery.

SMS COMMUNICATIONS: By providing your phone number, you expressly consent to receive text messages from EnviroGuard Solutions for service-related purposes, including scheduling, reminders, and updates about your services. Standard SMS rates may apply. You may opt out of SMS communications at any time by texting “STOP” to cancel future messages. Message frequency may vary, and we will only send communications directly related to your services.

OPT-OUT AND CONSENT WITHDRAWAL:You may opt-out of communications at any time by following the instructions provided in the message. You may withdraw your consent for SMS communications at any time by texting “STOP” to cancel. Withdrawal of consent does not affect any prior communications sent before your opt-out request.

CAUTION: Do not touch, handle, or approach any captured animals, as they can bite and may carry diseases. Do not attempt to feed or give water to the animals. Trapped animals must remain at the trap site until they are removed by an authorized EnviroGuard Solutions representative. EnviroGuard Solutions is not liable for any injuries sustained by individuals at the trap site or job location. All animals trapped will be removed in accordance with local and state laws. Any attempt to tamper with or steal traps will result in legal action. Any wrongdoing should be reported to EnviroGuard Solutions immediately at (866) 642-4155.

SERVICE GUARANTEE: EnviroGuard Solutions guarantees most services for one year from the date of completion unless otherwise documented, provided all payments have been made to EnviroGuard Solutions. Services with a balance due will not be guaranteed. The guarantee includes all patchwork, sealing, and repairs performed, as well as the removal of nuisance animals as specified in the contract. EnviroGuard Solutions is not responsible for ceiling damage that may occur due to technicians working in attics, including stress cracks, holes, and nail pops. This guarantee does not cover animal re-entry through non-repaired areas or structures vulnerable to damage, such as cedar siding, cedar shake roofs, or water-damaged areas. Unless specifically outlined in the agreement, the guarantee does not apply to the reinfestation of waterways or open lands by animals like beavers, muskrats, foxes, or bobcats. Liability is limited to the value of the services rendered and paid by the client. Failure to complete recommended repairs voids the warranty for future animal or pest issues in those areas. The guarantee only covers areas modified by EnviroGuard Solutions as outlined in the service agreement.

PAYMENT TERMS: A deposit of 50% is required at the time of scheduling services, except for Trapping Services, which must be paid in full before traps are set. No deposits are needed for recurring services. All payments must be made to EnviroGuard Solutions, with any remaining balance due on the first service date. Unpaid balances over 30 days will incur a 2% monthly interest charge. Accounts overdue by 60 days may result in service suspension and referral to a collection agency and/or legal action may be enforced such as a property-lien. Customers agree to cover collection costs, including attorney fees. Final payments cannot be delayed due to pending city or county inspections. All materials remain the property of EnviroGuard Solutions until fully paid. Prices may change if additional insurance is required, and any required vendor registration fees will be billed to the customer. For your convenience EnviroGuard Solutions accepts Visa, Mastercard, Discover, and American Express. By signing this agreement, the customer acknowledges receipt and understanding of EnviroGuard Solutions’ policies and agrees to the charges. The customer agrees that all services will be automatically charged to their credit card upon completion. If a credit card payment is declined, alternative arrangements must be made. EnviroGuard Solutions may terminate services if payment is not received. EnviroGuard Solutions reserves the right to charge a $35.00 fee for returned checks, including checks marked Stop Payment.

GOVERNING LAW: Any disputes or claims arising from this agreement, including its negotiation, signing, or performance, must be resolved through binding arbitration with the American Arbitration Association. Arbitration will take place in the state where the services were performed. The parties waive all claims for punitive or exemplary damages to the extent allowed by law.

SEVERABILITY: If any part of this agreement is deemed invalid or unenforceable by law, the remaining provisions will continue to be valid and enforceable. The invalidity of one section does not affect the rest of the agreement.

PEST CONTROL SERVICES/RECURRING SERVICES: These services are valid for one calendar year and/or the number of services specified in the agreement. After that period, the service will continue unless canceled by the customer with 30 days’ written notice. To cancel, send a signed and dated notice to EnviroGuard Solutions by mail, email, or fax. CANCELLATION POLICY: The customer acknowledges receipt of this contract and agrees that they have read and understood its terms. Services not yet provided may be canceled within three (3) business days without penalty. After three days, a cancellation fee of 30% of the total agreement amount will apply. For Pest Control and Recurring Services: In the event of early termination, customers with a recurring service agreement will be charged the equivalent of two services or the remainder of contracted services, whichever is less. To cancel, a signed and dated notice must be sent to EnviroGuard Solutions by mail, email, or fax. I acknowledge that I have read and understand the terms of this agreement and accept it in full for the services provided. I agree to receive electronic communication at the email address associated with my EnviroGuard Solutions account. Additionally, I consent to receive SMS messages related to my account.  I also understand that payment is due at the time of service unless other arrangements have been made in advance with EnviroGuard Solutions.

We do not share your phone number for SMS purposes with any third parties. You may opt-out of SMS communications at any time by texting “STOP” to cancel future messages. Message frequency may vary, and standard SMS rates may apply.

DATA SECURITY: We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.

YOUR RIGHTS AND CHOICES: You have the right to access, update, or delete your personal information. You may also opt-out of marketing communications at any time by following the instructions provided in our messages.
